RELEASE, WAIVER, LIMITATION OF LIABILITY AND NO REFUND AGREEMENT ("AGREEMENT")

IN CONSIDERATION of being permitted to participate in any way in the USPS San Diego Career Awareness Conference, you agree to the following:

RELEASE AND WAIVER OF LIABILITY

Participant, by signing this Agreement and participating in the Event, expressly agrees that the Postal Service shall not be liable for any claims, losses, expenses, damages, demands, settlements, and judgments arising from any loss or personal injury. Participant assumes full responsibility for any such claims, losses, expenses, damages, demands, settlements, and judgments which may occur to the Participant, its partners, or affiliates, and Participant agrees to hold the Postal Service harmless.

In the event that any claim is filed against the United States Postal Service for injuries sustained during the event, please note that tort claims against the Postal Service are governed by the provisions of the Federal Tort Claims Act. 28 U.S.C. §§ 2671−2680, and as such, claims can only be brought for liability arising from the negligent or wrongful action or omission by a Postal Service employee while acting within the scope of his employment, under circumstances where the United States, if a private person, would be liable in accordance with the law of the place where the negligent or wrongful act or omission occurred. 28 U.S.C. § 2674.

This release and waiver will survive the expiration, lapse, or other termination of this Agreement and releases any and all claims, losses, expenses, damages, demands, settlements, and judgments.

FORCE MAJEURE

Participant agrees to release the Postal Service from liability for any failure or delay in performance under this Agreement to the extent said failures or delays are proximately caused by causes beyond the Postal Service’s reasonable control and occurring without its fault or negligence, including, without limitation, failure of suppliers, fire, floods, acts of Government, wars, riots, subcontractors, or inclement weather.

NO REFUND POLICY

Participant understands that in the event of a force majeure, Participant has no right to claim any reimbursement or other compensation for registration fees paid prior to the conference.

FOR THE AVOIDANCE OF DOUBT, IN NO EVENT SHALL ANY REFUNDS BE GRANTED TO PARTICIPANTS EVEN IF THE EVENT IS CANCELLED DUE TO A FORCE MAJEUR EVENT, AND NO REFUNDS WILL BE GRANTED FOR PARTICIPANTS WHO PRE-PAYED, BUT DID NOT ATTEND THE EVENT.

PUBLICITY RELEASE

By signing this release, I irrevocably consent to the Postal Service’s use of materials by or about me that may include my name, title, photos of me, quotes from me, text I have written or things I have said in connection with the Event, information about the work I perform for the Postal Service, and biographical information. Such use may include, without limitation, broadcasting, printing, social media, publishing, displaying, televising, and any other means of public dissemination and dissemination through internal Postal Service channels.
